Advertisers' Terms and Conditions

  1. You must include a full postal address as well as further contact details in order for an advert to be accepted by wardtimes. Such information will not be released to third-party companies and only the contact details you request to be viewable on your advert will be made public. All personal details are retained in compliance with the Data Protection Act 1998.
  2. wardtimes reserves the right to make any alteration within an advertisement it deems necessary or desirable and to require other material to be amended to meet its approval.
  3. Whilst wardtimes will try to meet the advertisers wishes wherever possible, wardtimes cannot guarantee the insertion, position and availability of all advertising options at any particular time.
  4. All intellectual property rights (IPRs) including, without limitation, copyright, trademarks, database and design rights (whether registered or not) in any copy, text, artwork, photographs or any other materials we have created and/or in any way altered for you shall belong to wardtimes. The advertiser must, at our request, sign and execute any such documents needed to reasonably give IPRs to wardtimes for us to protect and enforce them.
  5. Regarding any material supplied to us (other than the above we have already mentioned) you grant us non-exclusive, irrevocable, perpetual and royalty free licence to use this material for any purpose.
  6. All material submitted by you must not violate, plagiarise, or infringe the rights of third parties (including copyright, trademark, personal rights, etc.)
  7. No advert (or part of an advert) placed with wardtimes may be reproduced in any other publication without our explicit written consent prior to any further publication. You cannot licence, permit or authorise any such reproduction.
  8. You are not allowed to advertise anything that is prohibited by wardtimes. wardtimes reserves the right to refuse to publish an advert which they feel breach these rules and can cancel any advert they feel has breached these rules;
    1. No pornographic material (Similarly, anything that is threatening, defamatory, obscene, indecent, seditious, offensive, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence or in breach of privacy is also prohibited)
    2. You cannot publish anything which you have not obtained all necessary licenses and/or approvals for;
    3. No copies. This includes jewellery, CDs/DVDs (games, music, films, etc.), clothes, perfume, etc. The sale of copies is illegal.
    4. You may not try to sell any weapons, without limitation (e.g. knives, guns (including de-activated arms), bows, catapults, swords, etc.)
    5. No alcohol, cigars or cigarettes. wardtimes is not licensed to sell these items.
    6. No prescription medicines.
  9. The term puppy/kitten is understood by wardtimes as any dog/cat under the age of 6 months.
  10. You are not permitted to sell any endangered species, dangerous dogs (as defined under the Dangerous Dogs Act 1991) or other inappropriate animals.
  11. All fee-paying adverts must be pre-paid before wardtimes will publish an advert. We are not obliged to publish any advert which has not been paid in advance. However, wardtimes has the right by its own discretion to waive this under certain circumstances.
  12. Any late payment will accrue a charge of £5 for administration. This can be waived under exceptional circumstances on the discretion of wardtimes.
  13. wardtimes have the right to change our advertising rates and adjust terms in regards to space and frequency of insertion at any time and for any reason. The new rates and terms will apply on any advertising placed after the publication of the new rates. Displaying the changed terms and rates on the wardtimes site constitutes publication of the new rates.
  14. When payment is taken online through our website advertisers will be directed to a dedicated payment provider (i.e. PayPal). This provider will take payment using a secure server (SSL) connection so as to ensure the safety of your payment online. Whilst wardtimes will do its utmost to secure advertisers’ safety we cannot take any liability for any loss or damage incurred due to the use of this secure payment method.
  15. On occasions, confirmation of payment will be delayed from the dedicated payment provided (i.e. PayPal). It is possible that on these occasions moderation and acceptance of an advertisement will be delayed. wardtimes will do its best to notify and reduce any such delays as much as is reasonably possible.
  16. The advertiser agrees to check that the advert is correct. Responsibility for accuracy is therefore the advertisers’.
  17. All material published by wardtimes is published in good faith. Any inaccuracies or otherwise are under no circumstances the responsibility of wardtimes.
  18. wardtimes are entitled to terminate an advert at any time;
    1. Advertisers agree that wardtimes may, at their discretion, remove an advert immediately if they believe the advertiser has violated the Terms and Conditions.
    2. wardtimes are entitled to terminate an advert at any time by giving the advertiser 7 days written notice.
    3. wardtimes can also terminate an advert immediately if the advertiser fails to pay their advertising fees on time.
  19. wardtimes needs 14 clear days notice in order to cancel or reduce the size, level or form of an advert already entered.
  20. wardtimes reserves the right to cancel an advert at its own discretion at any time. If any advert is cancelled for breaching the Terms and Conditions then wardtimes reserves the right to charge the advertiser any financial loss incurred in doing so and, where necessary, charge a cancellation fee of £5. Both can be waived at the discretion of wardtimes.
  21. Once an item has been sold it is possible to delete an advert from the wardtimes site. However, no partial refunds can be or will be made for an early cancellation.
  22. For trade/business advertisers the below conditions apply in addition to the above Terms and Conditions for private advertisers;
    1. The Business Advertisement (Disclosure) Order 1977 requires all advertisements in which people are trying to sell good in the course of business must ensure that this fact is made clear to the reader.
    2. 22a applies to all people. Whether the advertiser is acting on his/her own behalf as a representative of the business or on that of another person it still applies.
    3. Customers must be able to distinguish between adverts relating to trade/business advertisers or private advertisers.
    4. It is the responsibility of the advertiser to comply with this Order. Failure to do so is an offence for which you can be prosecuted.
    5. Placing a business advert with wardtimes amounts to the acceptance of the above conditions.
  23. wardtimes reserves the right to modify these Terms and Conditions as and when required. These modifications will come into effect immediately once the changes have been notified to you. Displaying the modified conditions on the wardtimes website constitutes a notification.
  24. If any of these Terms and Conditions are decided to be illegal, invalid or otherwise unenforceable by law then that term or condition will be deleted from these Terms and Conditions. However, the remaining terms shall remain in full force and continue to be binding and enforceable.
